Judiciary

The Judiciary branch of United Stands of Lemonade will comprise of Citizens that are not part of the Executive, Citizen House or Reserve. They will be entrusted with the responsibility of protecting the Constitution- serving as an independent and impartial body for arbitrating disputes between:

  • Citizens

  • Branches of the Government

  • Citizen House and Token House

  • Citizens and Branch of Government

The overall functions of the Judiciary are listed below.

Administration of Justice

The chief function of the judiciary is to apply the Working Constitution to specific cases or in settling disputes. When a dispute is brought before the branch it ‘determines the facts’ involved through evidence presented by the contestants. The members of the Judiciary arbitrate based on a case by case basis. If someone is found guilty of violating the Working Constitution in the course of the trial, members of the jury have the right to impose a penalty within reason.

Creation of Judge-case Law

In many cases, the judges are not able to, or find it difficult to select the appropriate law for application. In such cases, the judges decide what the appropriate law is on the basis of their wisdom and common sense. In doing so, judges build up a body of ‘judge-made law’ or ‘case law.’ As per the doctrine of ‘stare decisis’, the previous decisions of judges are generally regarded as binding on later judges in similar cases. This process builds a database of disputes and decisions that inform the decisions of the executive on what law can be moved to smart contracts over time.

Guardian of the Constitution

The members of the Judiciary act as the guardian of the Working Constitution. The conflicts of jurisdiction between the branches of the Government or between the legislature and the executive are decided also decided by the Judiciary. Any law or executive order which violates any provision of the constitution is declared unconstitutional or null and void by the judiciary. This is called ‘judicial review.’ Judicial review has the merit of guaranteeing the fundamental rights of individuals and ensuring a balance between the Government branches and community.

Protector of Fundamental Rights

The judiciary ensures that people’s rights are not trampled upon by any branch of the Government- and can enforce Fundamental Rights by issuing writs.

Advisory Functions

Judiciary, in addition, performs an advisory function. It can give its advisory opinions on constitutional questions. This is done in the absence of disputes and when the Executive or Legislature branches so desires.

Special Roles

The judiciary also performs the important task of settling disputes between the Government bodies and Lemonade Stands. It also acts as an arbiter of disputes between states.

Conducting judicial enquiries

Members of the Judiciary can be called upon to head commissions that enquire into cases of errors or omissions on the part of members of the Legislature, Executive or Reserve branches of United Stands of Lemonade.

This branch of the government will be developed iteratively and intentionally, over time moving to smart contracts where possible keeping into account that while code is law, some situations will require humans and humanity.
